Active shooter incidents are occurring once every three weeks on average, according to a report from the Federal Bureau of Investigation (FBI). These tragedies are happening at diverse venues including business establishments, public places, schools and healthcare facilities. Active shooter incidents are shaping a legal landscape, as victims and their families are increasingly turning to legal recourse against the owners of premises where the incidents occur. Allegations include arguments that these shootings can no longer be considered outside the realm of possibility; therefore, a legal duty to protect consumers, students, patients, and the public, exists.
